Definitions:

'Terms and Conditions' refers to the current Terms and Conditions at the time of booking as published on the Company's web site.

The 'Company' refers to 'Sierra trekking'.

'Sierra Trekking' is the trading name of the Company of which Mark Ainsworth of the registered address above is the Proprietor.

The 'Customer' refers to any person or organisation trading with the Company or it's employees or sub-contractors whether relating to the Companies products or services.

'Service' refers to any holiday, course, accommodation or service offered by the Company.

'Contract' refers to the agreement between the Company and the Customer in relation to a booking.

Applicability:

These Terms and Conditions shall be part of the Contract between the Company and the Customer. Any other Terms and Conditions from any source or by way of Custom or Practice are not applicable.

Jurisdictions and Laws:

These Terms and Conditions and any terms and conditions relating to products or services described in this website shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising in relation to the same shall, unless otherwise expressly agreed, be subject to the exclusive jurisdiction of the courts of England and Wales.

Booking Conditions:

Customers must be aware of and accept that all Outdoor or Adventure activities carry a degree of risk. All customers must confirm that appropriate and adequate Insurance will be in place for the activities undertaken.

A Contract will not be valid until the Company has confirmed to the Customer the acceptance of a booking.

All information published on the Company web site and otherwise communicated to Customers is given in good faith. The company cannot accept responsibility for any inaccuracies or changes to this information or for the consequences thereof.

Customers must accept any decision taken by representatives of the Company in relation to itinerary changes whether for safety or any other reasons.

Customers under the age of 18 are accepted only if accompanied by a parent/guardian and with the express consent of the Company.

Payment:

Places will only be confirmed upon receipt of the Booking Form and appropriate deposit. Once your booking has been approved, the Company will confirm acceptance of the booking in writing.

Deposits:

The following deposits will apply and are non-refundable:-
For 1 week holidays or longer - £100 per person
For 3 or 4 day breaks or courses - £80 per person
For 1 or 2 day activities - £50 per person

Deposits may be paid via Google Checkout with no additional costs, payment of final balance via Google checkout will incur additional costs - see "Final Balance" below.

Final Balance:

Full payment is due no later than 8 weeks prior to the commencement date. No reminder will be sent and the Company reserves the right to cancel bookings if full payment is not received by the required date. Deposits will be forfeited in such circumstances.

If the final balance is paid via Google checkout a surcharge of 3.5% of the outstanding balance is added to cover charges.

Dishonoured cheques:

The Company will impose an administration fee of £25 in the case of any dishonoured cheques.

Cancellation Policy:

Cancellation by the Customer - Any cancellation by the Customer must be made in writing and will not be valid until receipt by the Company is acknowledged.

Cancellation charges -

More than 8 weeks prior to commencement date - Loss of all deposits paid.
Between 4 and 8 weeks prior to commencement date - 50% of the total cost of booking.
Between 1 and 4 weeks prior to commencement date - 75% of the total cost of booking.
Less than 1 week prior to commencement date - 100% of the total cost of booking.

Cancellation by the Company - We at Sierra Trekking will make every effort to ensure that your booking is honoured.

If a cancellation is necessary the Company will inform the Customer at the earliest opportunity. In the event of a cancellation, a full refund will be offered to the customer, alternatively the Customer will be offered the opportunity to transfer to a different date or itinerary.

Amendments -

By the Customer - The Company will endeavour to accommodate changes to bookings where possible. Customer name changes will be subject to an administration fee of £25.

Any request to change to a different itinerary or date will be treated as a cancellation and therefore subject to the cancellation policy.

By the Company - Itineraries are subject to change due to unforeseen circumstances, accommodation availability, weather conditions and other reasons. The Company reserves the right to modify itineraries where necessary.

Medical Conditions:

All Customers must inform the Company of any relevant Medical Condition, Allergy or Disability at the time of booking. Any changes in this regard in between booking and the commencement date must also be communicated to the Company.

Dietary requirements:

The Company will try to accommodate any special dietary requirements, we cannot guarantee that these can be accommodated at all times. Please make us aware of any special requirements at the time of booking.

Fitness and Activity Gradings:

The customer is responsible for reading the relevant holiday description and choosing an appropriate grade.

It is essential that an appropriate itinerary for ALL members of your party is chosen.

Any customer whose health or lack of fitness may cause either a safety issue or an inappropriate pace for the group may be prevented from taking part in the chosen activities. No refund can be offered in this situation. In such circumstances the customer may have to make alternative arrangements for accommodation and or transport and the Company accepts no responsibility for this, financial or otherwise.

Inappropriate Behaviour:

Any behaviour on the part of a Customer which is deemed to be inappropriate or which impacts negatively on other group members, representatives of the Company or the local community may result in a suspension of activities for that person or persons. No reimbursement of fees paid will be offered by the Company in this situation.

Personal Property:

The Company accepts no liability for loss of or damage to personal property belonging to any Customer other than due to the negligence of a representative of the Company.

Force Majeure:

As is standard in the travel industry the Company has no liability in respect of any failure or delay in the delivery of products or services due either directly or indirectly to any cause which is outside the control of the Company including but not limited to, acts of God, war, invasion, rebellion, disorder, malicious damage, epidemic, pandemic, quarantine restrictions, flood, fire, strikes or other industrial disputes, severe weather or utility provision.

Limits of Liability:

The Company's liability is limited to the maximum extent permitted by law as follows.

The Company has no liability for any loss or damage incurred by the Customer or any other person.

For any claim arising on an invoice issued more than 3 months before the date on which such a claim is received by the Company.

Any failure of the Company to discharge it obligations in relation to the Companies Terms and Conditions that is caused by circumstances beyond the Company's control.

Photographs:

The Company may publish photographs of its activities on its web site or elsewhere. If you object to being photographed or to having photographs published then please make us aware of this prior to your holiday or course.

BMC Participation statement

The BMC recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement.

This statement applies equally to hillwalking and all other outdoor activities.
